Ignoring the elephant in the room doesn't make it go away. It just makes it harder to deal with. Having already discussed my skepticism toward the International Criminal Court (ICC) reliance on the Situation in Burundi and Article 70 of the Vienna Convention on the Law of Treaties (VCLT) in last week's column, today's #JustThinking zeroes in on Article 127(2) of the Rome Statute. The provision says that a state's withdrawal shall not 'prejudice in any way the continued consideration of any matter which was already under consideration by the Court[.
